Family Legacy & Nomination Checklist
Audit your nominations and will under Indian succession law. Protect your family from avoidable disputes.
Critical Indian Law Distinction: Nominee vs Legal Heir
Under Supreme Court precedent (Sarbati Devi v. Usha Devi), a nominee in bank accounts and mutual funds is merely a custodian who receives funds to distribute to the legal heirs. The nominee does NOT automatically own the money unless they are also named the sole legal heir in a valid Will.

Simple Handwritten Will Executed & Witnessed
Valid Handwritten Will in India: 4 Essential Rules
1. Plain Paper is 100% Legal: Under Section 63 of the Indian Succession Act 1925, a Will can be written in ink on plain blank paper in any language you know. Stamp paper is NOT mandatory.
2. Registration is Optional: Registration is not legally mandatory for a Will to be valid. What is mandatory is your signature and the signature of two witnesses.
3. Two Non-Beneficiary Witnesses: The two witnesses who sign must NOT be beneficiaries (they or their spouses must not inherit anything in the Will).
4. Sound Mind & Date: State that you are in sound mental health, revoke all previous Wills, write the exact date, and sign at the bottom of every page.
